You, the User of our services, confirm that you have read and understood the provisions of the National Customer Preference Register (NCPR) of the Telecom Regulatory Authority of India (TRAI). The purpose of this registry is to reduce or eliminate unsolicited commercial communications (SPAM) to users.
You agree to comply with all applicable TRAI regulations, DLT (Distributed Ledger Technology) registration requirements, and any other telecom regulations governing the sending of SMS, voice calls, or other electronic communications in India. 3. Acceptable Use
You agree to use SpringEdge services for lawful purposes only. You are solely responsible for all content sent through our platform using your account. The following activities are strictly prohibited:
- Sending unsolicited commercial messages (SPAM) in violation of TRAI regulations
- Transmitting content that is fraudulent, misleading, defamatory, obscene, or illegal
- Using the service to harass, threaten, or cause harm to any individual or organisation
- Attempting to gain unauthorised access to SpringEdge systems, networks, or other user accounts
- Sending messages that impersonate another person or entity
- Using the platform for phishing, malware distribution, or any form of cyber fraud
4. Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials, including your API keys, username, and password. You agree to notify SpringEdge immediately of any unauthorised use of your account or any other security breach.
All activities conducted through your account are your responsibility. SpringEdge shall not be held liable for any loss or damage arising from unauthorised use of your account.
5. Pricing and Telecom Charges
You understand and agree that telecom operators may increase the price of their services at any time. Such increases are beyond the control of SpringEdge. In such cases, SpringEdge reserves the right to pass on the increased costs to you — either fully or partially — by way of additional charges or proportionate deduction of credits from your prepaid account.
You also understand and agree that interconnect charges, if applicable in the future or retrospectively on any Indian or supporting overseas network, shall be charged separately and adjusted in your prepaid balance by SpringEdge.
6. Refund Policy
SpringEdge operates on a prepaid credit model. Refund claims will not be entertained under any circumstances once credits have been purchased and added to your account. It is your responsibility to evaluate the service before making a purchase.
7. Service Availability and Force Majeure
SpringEdge strives to maintain uninterrupted service but does not guarantee 100% uptime. You understand and agree that SpringEdge will not be liable to compensate or indemnify you for any lack or non-provision of service due to circumstances beyond our control, including but not limited to:
- Natural calamities (floods, earthquakes, fire)
- Power breakdowns or network outages
- Telecom operator downtime or technical failures
- Government actions, regulatory changes, or changes in law
- Terrorist attacks, civil unrest, or acts of war
- Pandemics or public health emergencies
8. Intellectual Property
All content on the SpringEdge website — including text, graphics, logos, icons, images, software, and documentation — is the property of SpringEdge Technologies Private Limited and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on our website without prior written permission.
9. Limitation of Liability
To the maximum extent permitted by law, SpringEdge shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our services. This includes, but is not limited to, loss of revenue, data, business opportunities, or goodwill.
Our total liability for any claim related to the service shall not exceed the amount you have paid to SpringEdge in the twelve (12) months preceding the event giving rise to the claim.
10. Account Termination
SpringEdge reserves the right to suspend or terminate your account at any time, without prior notice or liability, if we determine that you have violated any of these Terms of Use. Upon termination, your right to use the services will immediately cease, and any remaining credits in your account will be forfeited.
11. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms or your use of SpringEdge services shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.
12. Modifications to Terms
SpringEdge reserves the right to modify these Terms of Use at any time. Changes will be posted on this page with a revised effective date. Your continued use of the website and services after any changes constitutes your acceptance of the updated terms. We encourage you to review this page periodically.
